Die aktuellste Version finden Sie immer auf unserer Website.<\/p><p><strong><u>Abschnitt II: Datenverarbeitung im Zusammenhang mit der Nutzung der StopCrime-Datenbank<\/u><\/strong><\/p><p>Die nachfolgenden Bestimmungen enthalten Informationen zur Verarbeitung personenbezogener Daten im Zusammenhang mit der StopCrime-Datenbank. Soweit nachfolgend nicht abweichend dargestellt, gelten die Bestimmungen des Abschnitts I. entsprechend.<\/p><ol><li><strong>Allgemeine Informationen zur StopCrime-Datenbank und der gemeinsamen Verantwortung<\/strong><\/li><\/ol><p>Die StopCrime GmbH (im Folgenden: <strong>\u201eSTOPCRIME\u201c<\/strong>), betreibt eine Plattform (im Folgenden auch: <strong>\u201eStopCrime-Datenbank\u201c<\/strong>) zum Zweck der Verhinderung von Geldw\u00e4sche, ihrer Vortaten oder der Terrorismusfinanzierung. Nach dieser Ma\u00dfgabe legt STOPCRIME die Ausgestaltung der StopCrime-Datenbank und Auswahl der Teilnehmer fest.<\/p><p>Teilnehmer der Plattform sind Verpflichtete i.S.v. \u00a7 2 Abs. 1 Nr. 1 bis 9 Geldw\u00e4schegesetz (GwG), welche auf Basis einer gesonderten (schuldrechtlichen) Vereinbarung mit STOPCRIME die StopCrime-Datenbank nutzen und in diesem Zusammenhang personenbezogene Daten von anderen Teilnehmern bzw. deren Ansprechpartnern sowie Informationen nach Ma\u00dfgabe von \u00a7 47 Abs. 5 GwG erlangen oder zug\u00e4nglich machen. Sonstige Personen, insbesondere die Kontoinhaber auff\u00e4lliger Konten haben keinen Zugang zur Plattform.<\/p><p>Durch eine Einmeldung k\u00f6nnen von den Teilnehmern auff\u00e4llige Sachverhalte i.S.v. \u00a7 47 Abs. 5 GwG in der StopCrime-Datenbank hinterlegt und f\u00fcr andere berechtigte Teilnehmer sichtbar gemacht werden. Bei den eingemeldeten Sachverhalten handelt es sich daher um Informationen \u00fcber konkrete Sachverhalte, die auf Geldw\u00e4sche, eine ihrer Vortaten oder Terrorismusfinanzierung hindeutende Auff\u00e4lligkeiten oder Ungew\u00f6hnlichkeiten enthalten. Eine \u00dcberpr\u00fcfung durch STOPCRIME, ob die Einmeldungen die Voraussetzungen von \u00a7 47 Abs. 5 GwG erf\u00fcllen, erfolgt nicht.<\/p><p>Je nach Vertragsgrundlage mit STOPCRIME und damit der sich f\u00fcr den Teilnehmer ergebenden Teilnehmerstufe, unterrichtet STOPCRIME die Teilnehmer (im Folgenden: <strong>\u201eberechtigte Teilnehmer\u201c<\/strong>) \u00fcber Aktualisierungen und ggf. erfolgte Korrekturen der StopCrime-Datenbank.<\/p><p>Der Austausch zwischen den berechtigten Teilnehmern umfasst regelm\u00e4\u00dfig die Informationen nach Ma\u00dfgabe von \u00a7 47 Abs. 5 GwG, d.h. beispielsweise die Konto(inhaber)daten zum eingemeldeten Konto, den Grund f\u00fcr die Einmeldung des einzelnen Kontos in die StopCrime-Datenbank, das Datum der Einmeldung und den Namen des einmeldenden Teilnehmers. Berechtigte Teilnehmer k\u00f6nnen zu den Zwecken des \u00a7 47 Abs. 5 GwG Einsicht in die StopCrime-Datenbank nehmen und einen einzelfallbezogenen Abgleich der bei einer Transaktion angegebenen Daten mit den in der StopCrime-Datenbank aufgef\u00fchrten Daten vornehmen. Sollte es zu einem \u201eMatch\u201c kommen, entscheidet der jeweilige Teilnehmer selbst \u00fcber das weitere Vorgehen, z.B. das Anhalten einer Transaktion zur Kl\u00e4rung, ob eine strafbare Handlung vorliegt. Ein Eintrag in der StopCrime-Datenbank hat somit lediglich den Charakter eines Warnhinweises ohne Bewertung oder Empfehlung durch STOPCRIME.<\/p><p>Im Rahmen der Nutzung der Plattform sind STOPCRIME und die Teilnehmer der Plattform f\u00fcr die Verarbeitung von personenbezogenen Daten gemeinsam verantwortlich. Gem\u00e4\u00df Art. 26 Abs. 1 DSGVO sind mehrere Stellen \u201egemeinsam f\u00fcr die Verarbeitung Verantwortliche\u201c, wenn sie gemeinsam die Zwecke der und die Mittel zur Verarbeitung festlegen. Auch wenn STOPCRIME vorliegend die Grundlagen f\u00fcr die Datenverarbeitung innerhalb der Plattform bestimmt, entscheiden die Teilnehmer letztlich selbstst\u00e4ndig \u00fcber die Einmeldungen und die damit verbundenen Daten, die in der StopCrime-Datenbank hinterlegt werden, geben individuelle Bewertungen ab und treffen im Zusammenhang mit der Nutzung der Daten aus der StopCrime-Datenbank selbstst\u00e4ndige Entscheidungen. In der Abgrenzung zur gemeinsamen Verantwortung liegt insbesondere keine Auftragsverarbeitung vor (z.B. alle Teilnehmer sind Verantwortliche und STOPCRIME ist Auftragsverarbeiter). Dies bereits deshalb, weil STOPCRIME nicht nach den Weisungen der Teilnehmer Daten verarbeitet.<\/p><p>STOPCRIME hat mit den Teilnehmern einen Vertrag nach Ma\u00dfgabe von Art. 26 DSGVO geschlossen. Dieser Vertrag konkretisiert die datenschutzrechtlichen Verpflichtungen der Beteiligten in den unterschiedlichen Leistungsbeziehungen, soweit diese eine gemeinsame Verarbeitung von personenbezogenen Daten im Sinne der DSGVO zum Gegenstand haben. Wesentliche Bestimmungen aus dem Vertrag werden nachfolgend dargestellt.<\/p><ol start=\"2\"><li><strong>Datenverarbeitung und Rechtsgrundlagen<\/strong><\/li><\/ol><p>Im Zusammenhang mit der StopCrime-Datenbank sind im Wesentlichen die folgenden Rechtsgrundlagen zur Datenverarbeitung ma\u00dfgeblich. Lastschrift, \u00dcberweisung, Instant-Payment-Transaktion, Meldebegr\u00fcndung<\/p><\/td><\/tr><tr><td width=\"150\"><p><strong>Kategorien betroffener Personen<\/strong><\/p><\/td><td width=\"198\"><p>Kunden des Teilnehmers, Dritte bei denen Informationen \u00fcber konkrete Sachverhalte, die auf Geldw\u00e4sche, eine ihrer Vortaten oder Terrorismusfinanzierung hindeutende Auff\u00e4lligkeiten oder Ungew\u00f6hnlichkeiten enthalten, vorliegen, Teilnehmerdaten<\/p><\/td><td width=\"208\"><p>Kunden des Teilnehmers, Dritte bei denen Informationen \u00fcber konkrete Sachverhalte, die auf Geldw\u00e4sche, eine ihrer Vortaten oder Terrorismusfinanzierung hindeutende Auff\u00e4lligkeiten oder Ungew\u00f6hnlichkeiten enthalten, vorliegen, Teilnehmerdaten<\/p><\/td><\/tr><tr><td width=\"150\"><p><strong>Beschreibung der tats\u00e4chlichen Funktion und Beziehung der gemeinsam Verantwortlichen gegen\u00fcber betroffenen Personen<\/strong><\/p><\/td><td width=\"198\"><p>Teilnehmer erh\u00e4lt Zugang zu den Informationen in StopCrime-Datenbank und wird (in Abh\u00e4ngigkeit vom Hauptvertrag) \u00fcber Aktualisierungen informiert.<\/p><\/td><td width=\"208\"><p>STOPCRIME betreibt die StopCrime-Datenbank und legt in dieser Funktion die Auswahl und Ausgestaltung der StopCrime-Datenbank fest. \u00dcber der StopCrime-Datenbank h\u00e4lt STOPCRIME f\u00fcr die Teilnehmer Informationen \u00fcber konkrete Sachverhalte, die auf Geldw\u00e4sche, eine ihrer Vortaten oder Terrorismusfinanzierung hindeutende Auff\u00e4lligkeiten oder Ungew\u00f6hnlichkeiten enthalten zur Nutzung bereit, vermittelt zugleich den Zugang zur Nutzung der vorgenannten Daten an die berechtigten Teilnehmer und informiert berechtigte Teilnehmer \u00fcber Aktualisierungen.<\/p><\/td><\/tr><\/tbody><\/table><ol start=\"3\"><li><strong>Daten\u00fcbermittlung<\/strong><\/li><\/ol><p>STOPCRIME gibt personenbezogenen Daten nur an Dritte oder sonstige Empf\u00e4nger weiter, wenn dies zur Leistungserbringung erforderlich ist, eine gesetzliche Verpflichtung besteht oder die Datenweitergabe aufgrund einer sonstigen gesetzlichen Grundlage zul\u00e4ssig ist. Soweit erforderlich, hat STOPCRIME mit den Empf\u00e4ngern der Daten, so z.B. zum Zwecke des Hostings der Plattform, Vereinbarungen \u00fcber die Auftragsverarbeitung nach Ma\u00dfgabe von Art. 28 DSGVO getroffen.<\/p><p>Eine \u00dcbermittlung von personenbezogenen Daten an Empf\u00e4nger au\u00dferhalb der EU \/des EWR findet seitens STOPCRIME nicht statt.<\/p><ol start=\"4\"><li><strong>Dauer, f\u00fcr die personenbezogene Daten gespeichert werden \/ Kriterien f\u00fcr die Festlegung der Dauer<\/strong><\/li><\/ol><p>Personenbezogenen Daten werden, unter Ber\u00fccksichtigung der gesetzlichen Bestimmungen, zun\u00e4chst so lange gespeichert, wie es f\u00fcr die vorgenannten Zwecke der Verarbeitung erforderlich ist oder im Falle eines Widerspruchs z.B. keine zwingenden schutzw\u00fcrdigen Gr\u00fcnde entgegenstehen. In bestimmten F\u00e4llen, z.B. wenn eine gesetzliche Aufbewahrungspflicht besteht, werden die personenbezogen Daten jedoch nicht unmittelbar gel\u00f6scht, sondern zun\u00e4chst gesperrt. Soweit nicht andere gesetzliche Bestimmungen \u00fcber Aufzeichnungs- und Aufbewahrungspflichten eine l\u00e4ngere Frist vorsehen werden die Daten nach Ma\u00dfgabe der Verordnung (EU) 2024\/1624 des Europ\u00e4ischen Parlaments und des Rates vom 31. Mai 2024 zur Verhinderung der Nutzung des Finanzsystems f\u00fcr Zwecke der Geldw\u00e4sche oder der Terrorismusfinanzierung f\u00fcnf Jahre ab dem Tag der Beendigung der Gesch\u00e4ftsbeziehung oder ab dem Tag der Ausf\u00fchrung der gelegentlichen Transaktion bzw. ab dem Tag der Verweigerung der Aufnahme einer Gesch\u00e4ftsbeziehung oder der Verweigerung der Ausf\u00fchrung einer gelegentlichen Transaktion aufbewahrt und sodann gel\u00f6scht.<\/p><ol start=\"5\"><li><strong>Rechte der Betroffenen<\/strong><\/li><\/ol><p>Soweit die Daten in gemeinsamer Verantwortlichkeit i.S.d. Art. 26 DSGVO mit STOPCRIME verarbeitet werden, ist STOPCRIME zentral f\u00fcr die Wahrnehmung aller Betroffenenrechte zust\u00e4ndig. Other individuals, especially the owners of suspicious bank accounts, have no access to the platform.<\/p><p>The participants may log suspicious matters in accordance with Section 47(5) GwG in the StopCrime Database and make them visible for other authorised participants. The reported matters thereby constitute information on specific matters which involve abnormalities or unusual circumstances indicating money laundering, any related predicate offence, or terrorist financing. STOPCRIME does not review whether the reporting complies with the requirements of Section 47(5) GwG.<\/p><p>Depending on the contractual basis with STOPCRIME and the related level of participation of the participant, STOPCRIME notifies the participants (hereafter referred to as <strong>\u201cauthorised participants\u201d<\/strong>) about any updates and corrections to the StopCrime Database.<\/p><p>The exchange between the authorised participants regularly covers the information pursuant to Section 47(5) GwG, e.g. the account (ownership) data of the reported account, the reason for reporting the individual account in the StopCrime Database, the reporting date and name of the reporting participant. Authorised participants may view the StopCrime Database for the purposes of Section 47(5) GwG and perform a case-by-case comparison of the data provided in a transaction with the data listed in the StopCrime Database. Should there be a \u201cmatch\u201d, the participant individually decides on any further action, for example suspending a transaction for the purpose of clarifying whether a criminal offence is apparent. An entry in the StopCrime Database thereby has the character of a warning sign without assessment or recommendation by STOPCRIME.<\/p><p>Within the context of the use of the platform, STOPCRIME and the participants of the platform are joint controllers of personal information. Pursuant to Article 26(1) GDPR, several entities are \u201cjoint controllers\u201d where they jointly determine the purposes and means of processing. While STOPCRIME herein determines the basis for data processing within the platform, the participants ultimately independently decide on the reporting and related information retained in the StopCrime Database, provide individual assessments and make independent decisions with regard to the use of information from the StopCrime Database. In contrast to the joint control, there especially does not exist any commissioned processing (for example, where all participants are controllers and STOPCRIME is the processor).
